Terms of Service – Converta

About the Application

Converta (hereinafter: "the Application") is a web application that enables connection to campaigns and websites of business clients, and processes information received through their activities, including lead data and analysis. Use of the application and the analytical tools offered in it is subject to the terms of this agreement, and its purpose is to ensure fair, secure, and transparent use of the platform and the information transmitted through it.

The application owner may add services and/or products with free or paid access at their discretion.

General

These terms include, among other things, terms of use, privacy provisions, intellectual property provisions, and liability limitations. Please read all terms of use carefully. If you do not agree to one or more of the terms provisions, you must refrain from any use of the application.

The user agrees, by the very act of entering and browsing the application, to all the provisions of the terms. The terms are written in masculine form but are intended for all genders.

It is clarified and emphasized that these terms, in their entirety, will bind any person who uses the application, and/or purchases services or products through it, and/or a user who purchased a product and/or service for a third party.

Intellectual Property

The intellectual property in the application, including but not limited to, trademarks, copyrights, designs, logos, databases, domain name, texts, images, visuals, trade secrets, business information, and/or any other intellectual property/asset, belong to the application owner, or to a third party that authorized their use or display in the application, unless otherwise stated.

The user in the application has no permission or authority to make commercial use of the intellectual property in the application, and/or any use that is contrary to the provisions of the terms, unless they received written permission from the application owner.

Application Availability

The application is in beta stage, and therefore there may be malfunctions, disruptions, availability issues, inconsistencies in displayed information, delays in data processing, and technical bugs. Although reasonable efforts are made to ensure proper, continuous, and accurate operation, we cannot guarantee that the service will operate without interruptions, errors, or data loss.

The user declares that they are aware of the nature of the period and the limitations arising from it, and agrees that they will have no claim, demand, or lawsuit against the application, its rights holders, or anyone on their behalf for any damage, loss, or expense.

The application owner reserves the right to stop or change the application's operation without prior notice.

Limitation of Liability

The application is stored on a server secured by an external company. The application owner is not responsible for damage caused as a result of external intrusion into the application.

The application owner is not responsible for the content of external advertisements (images/links) that may appear and/or be embedded in the application and/or for content and/or information appearing on sites to which the links lead.

The application provides tools for data analysis, user behavior, and information collected as part of business activity, but it does not constitute a substitute for professional judgment or business decision-making. The user is solely responsible for using the information, implementing conclusions, and the implications of actions they take following data processing.

Prohibited Uses

• Do not perform any action that may harm the application, browsing availability, or displayed content
• Do not use software code or any electronic/digital action to harm the application
• It is forbidden to perform any action intended to use the application for commercial purposes without permission from the application owner
• Do not use the application to train AI models or external analytical systems
• Use the application only for legal purposes, for purposes permitted by law

License to Use User Content

The user hereby grants a non-exclusive license, limited to the contract period, to the application owner to scan, learn, and/or analyze information from their sites, CRM systems or similar management systems, and/or social networks and/or advertising or marketing platforms for the purpose of providing application services.

The user declares and undertakes that all information provided or accessible to the application in the context of use is collected, processed, and transferred lawfully, and that they have all permits, consents, and rights required by law.

User Responsibility

The user and they alone are responsible for any damage caused as a result of violation of the terms provisions. The user will indemnify the application owner for any damage, economic or otherwise, and/or any third-party claim or demand caused as a result of violating the terms.

Using the Application

Connection to the application is via username and password, or via Google OAuth-based authentication. Payment can be made using credit cards – Visa, Mastercard, and American Express.

Jurisdiction

The law applicable to any dispute or disagreement regarding these terms will be Israeli law, and the exclusive and unique jurisdiction in any matter related to these terms of use will be the court with subject matter jurisdiction in Tel Aviv-Jaffa.
